Child Care Transportation

The Board of Education recognizes there are students in the schools of West Babylon who are enrolled in certified and/or licensed child care facilities and attend these centers on a regular basis directly after school hours. These students are eligible for after school transportation to the certified and/or licensed child care facilities given that the facilities have shown evidence of certification and/or licensure, pursuant to Section 390 of Social Services Law, are within the boundaries of the West Babylon UFSD, and are more than .5 miles from the participating pupils' schools. Requests for transportation are filed in accordance with New York State Education Law § 3635 (1)(b)(ii)(e).

Transportation Services to Non-certified or                                                            File: EEAAB 
Unlicensed Child Care Facilities                                                                       

In lieu of transportation to and from the child's home, the district may provide transportation for any child attending kindergarten through eighth grade between the youngster's school and before and/or after school child care locations. This transportation is limited to child care locations that are within the attendance zone of the child's school. Requests for transportation are filed in accordance with New York Education Law, § 3635 (1)(b)(ii)(e).

No Idling Policy

West Babylon School District promotes safe schools and safe transportation. In a continuing effort to provide a safe environment for our district students, staff and residents the following regulation will be in effect under Chapter 670 of the Laws of 2007 enacted section 3637 of Education Law. The district will ensure that every driver of a school bus or other school vehicle turn off the engine while waiting for passengers to load or unload.

1. All district-owned and district-hired school or coach buses shall turn off their engines when students are loading or discharging or are awaiting loading or discharging, at all schools within the district or at any school or location to which West Babylon students are transported.
2. Exceptions-Limited Idling may be permitted when it is necessary for the following reason:
a) Mechanical Work
b) Maintaining an appropriate temperature for passenger comfort
c) Emergency evacuation where necessary to operate wheelchair lifts
3. No bus shall restart until they are ready to depart and students are clear from the rear of the bus and there is a clear path to exit the pick-up or drop-off area.
4. All other school district owned vehicles shall not idle while on school property.
5. All privately owned, company owned or other district buses/vehicles shall not idle on school property.
6. No bus including non-diesel shall idle for more than 5 minutes in the bus yard or off school property. Under New York Law, trucks and buses with diesel engines may not idle for more than 5 consecutive minutes (3 minutes in New York City).
Exception to the law:
a) When the engine is powering an auxiliary function such as loading or unloading cargo, or mixing concrete;
b) When running the engine is required for maintenance;
c) When fire, police, utility or other vehicles are performing emergency services.
7. This policy does not apply when buses are picking up or dropping off students at bus stops or if the is forced to remain motionless because of traffic conditions over which the operator thereof has no control.

Rider Eligibility Policy

Transportation shall be provided to students in the West Babylon School District in accordance with the requirements of the state law.

Boards of Education are legally required to provide transportation for students in kindergarten through eighth grade if they live between 2 and 15 miles from their school. Students in grades nine through twelve who reside between 3 and 15 miles from their school must also receive transportation. In addition, the district may provide greater service pursuant to voter approval.

In order to monitor the transportation system, the Board of Education recognizes that the goals of the system are:

1. to provide an efficient, effective and safe service;
2. to ensure that all students, whose handicapping condition or distance from school so dictate, receive necessary transportation;
3. to adapt the system to the demands of the instructional program;
4. to maintain transportation vehicles in the best possible physical condition;
5. to review school bus schedules and routing plans at least once a year to ensure that maximum efficiency is maintained; and
6. to review the eligibility for transportation of students residing in the district at least once a year to ensure that all entitled to the services receive them.

Subject to voter approval, the Board of Education shall provide transportation to students residing in the school district as follows:

1. for all elementary school students residing between .5 and 15 miles from school;
2. for all junior and senior high school students residing between .8 and 15 miles from school.

For purposes of providing transportation as required by this policy and the Education Law, the nearest available route from home to school shall be measured along the centerline of the public streets providing the most direct route from the middle of the driveway of the home, and if there is no driveway, from a point on the centerline of the street perpendicular from the middle of the main entrance of the dwelling place, to the middle of the driveway of the main entrance of the school to be attended.

Schedule and Routing Policy

The Board of Education has the responsibility to adopt bus routes for student transportation.

The Superintendent of Schools or her/his designee shall establish bus routes and determine bus locations. All bus routes and stops shall be submitted to the Board of Education for review. Any change of bus routes or stop locations due to road construction or other contingencies shall be left to the discretion of the Superintendent or a designee.

No bus stops will be located less than one half mile from the schools to which students from those stops are being transported with the exception of stops for certain youngsters with special education needs or for youngsters with medical concerns.

Students with special education needs must have transportation requirements specified on their Individualized Education Plans. Students with medical concerns must have a doctor's note indicating the need for special transportation consideration and the expected duration of service. Requests for medical transportation are to be reviewed by a school nurse or nurse/teacher and the Superintendent's designee(s). Any conflict regarding student need for medical transportation is to be resolved in consultation with the school physician.

School Bus Part of District Allergy Policy

School Buses
Unless required by a medical condition, there will be no eating of food on school buses going to and from school. All food is to remain in backpacks. Eating on the bus presents both a choking hazard and an allergy danger. The bus driver will be informed about any child with severe food allergies. A list of students with allergies will be on each school bus. Bus drivers will be provided with a description of the signs and symptoms of an allergic response and anaphylaxis. There will be designated seats up front, particularly for young children. Parents may arrange for a friend to sit with their child. These designated seats will be cleaned with wet soapy cleaner and wiped with disposable towels. All buses will be equipped with a reliable communication device, a radio and/or cell phone.

If possible, when there is a substitute bus driver, prior to the first run he will speak to the dispatcher and be briefed on the list of the child with allergies.

Student Conduct on School Buses

The safe and efficient operation of school buses requires the cooperation of parents and students. Riding to and from school on the bus is a privilege and each student is expected to respect the rights and safety of others on the bus.  The following policies and procedures for bus discipline are in effect in our district:

1. Parents have the responsibility for teaching self-control and good manners to their children while the school has the responsibility of educating and transporting.  If students cannot control their behavior on a school bus and continuously disrupt the safety and order of the bus and fellow students, they will lose their riding privilege.
2. School administrators will enforce these procedures as directed by the Board of Education.
3. Even though students are suspended from riding the bus, they are expected to be in attendance at school.

Behavior of Pupils Using School Buses
In the use of our buses, it is expected that the following rules will be observed:
1. All students will conduct themselves in an orderly fashion at all times.
2. Students must wait in an orderly line off the highway, and not damage or destroy private property.
3. Students must be on time for the bus.
4. Students must take a seat in the bus and remain seated until ready to exit. After the bus is unloaded, they should wait for a signal from the bus driver to cross in    front of the bus.  They must be sure to be visible to the driver.
5. Students must obey the driver's suggestions promptly and courteously. The driver is in full charge of the bus and students.
6. Loud, profane or obscene language will not be permitted.
7. Students must keep heads, arms, and hands inside the bus at all times and not drop or throw anything from a bus.
8. It is expected that students help keep the school bus clean and sanitary.  No eating or drinking permitted.
9. Vandalism will not be tolerated. Students will be expected to reimburse the district for damages.
10. Students must keep hands off emergency doors, roof hatches, and bus equipment.
11. Smoking is prohibited on school buses.

First Offense: Verbal warning

Second Offense: Assigned seat

Third Offense: First written report.  The driver will submit disciplinary report to the school.  The principal or designee will make a decision as to consequence.

Fourth Offense: Second written report.  Disciplinary action determined by the principal including warning to parent.

Fifth Offense: Third written report.  Suspension of bus privileges for an appropriate number of days.
Continual misbehavior may result in the suspension of bus privileges for an indefinite period.
Special Note:  If a student seriously threatens the safety of the bus, he/she may receive the severest consequence immediately.

Special Education Students

With regard to special education students who receive special transportation and are students who are serviced within self-contained classes, the law requires that special education students cannot be suspended based upon the exhibition of behaviors related to his or her handicapping condition.  Therefore, a special education student cannot be suspended from bus transportation because his or her handicapping condition manifests in behavioral problems.  Consequently, when a spcial education student's handicapping condition endangers the welfare of other students and/or himself, the district must provide alternate means of transportation.  The building principal wll consult with the district director for curriculum and student services to determine if the behaviors warrant disciplinary action or are related to the child's handicapping condition.  A letter to parents at each step by the administration with full information is critical.
